Tribunals

A Tribunal is a person or group of persons upon which a statutory power of decision is conferred by or under statute.  Tribunal hearing are not governed by the Municipal Act, 2001 or the City’s Procedural By-law but instead are governed by their establishing legislation, the Statutory Powers and Procedures Act, R.S.O. 1990 (“SPPA”) and procedures established under the SPPA.  Tribunals are subject to certain open meeting requirements as provided by their establishing legislation, the Statutory Powers and Procedures Act, R.S.O. 1990 (“SPPA”) and/or Procedures established under the SPPA as applicable

Board Information

To deal with applications for minor variances to the Zoning By-laws and consents (land severances) for properties in the City of Hamilton (which includes all properties located within the former municipalities of Ancaster, Dundas, Flamborough, Glanbrook and Stoney Creek)

In accordance with the Planning Act, the Committee of Adjustment is a committee made up of Hamilton residents chosen by Council. The Committee of Adjustment deals with:

Consents such as land severance
Minor variances
Role of the Committee of Adjustment
The committee can make minor variances to the City of Hamilton’s Zoning By-law to allow:

Enlargements extensions or changes to legal nonconforming uses
A parcel of land to be split into more than one lot or as a lot addition to abutting lands
Mortgages, partial discharge of mortgages, validation of title, access right-of-ways, easements and leases over 21 years
The committee may allow variances by following specific criteria. There are four main criteria that the committee reviews when making a decision including determining if:

The variance is minor
It is desirable for the appropriate development or use of the land, building or structure
The general intent and purpose of the by-law(s) is maintained
The Official Plan is maintained

 

Membership:

As per the Planning Act, citizen members are appointed, and remain members until new citizens are appointed.
